Appendix 2: Constitution of Aston Students’ Guild
NAME AND OBJECTS
1. The officially recognised student organisation shall be the Aston Students’ (hereinafter referred to as the Guild), as prescribed in the Charter of Incorporation and the Statutes of the University, and its objects shall be as stated in the University Ordinance on the Students’ Guild (XV).
MEMBERSHIP
2. Full members
All full-time students of the University shall be eligible to be full members; they shall be eligible for membership of Guild Council, and for office in the Guild. Full members shall be entitled to attend and vote at General Meetings of the Guild, and vote in referendums and appropriate Guild elections. This category includes full-time students who are on a full year placement outside the University.
3. Part-time members
Part-time students of the University, that is who are enrolled on part-time programmes, shall be eligible to be part-time members of the Guild with full membership status, shall be eligible for membership of Guild Council and for membership of the Executive Committee of Guild Council. Part-time members shall be entitled to attend and vote at General Meetings of the Guild, and vote in referendums and appropriate Guild elections.
4. Right to opt out
All students eligible for full or part-time membership of the Guild shall have the right not to be a member of the Guild.
Students who take up this right shall be entitled to make use of any of the facilities or amenities of the Guild, which may from time to time be made available to them. They may not attend any Guild meetings, nor become members of any Guild society, nor hold any office in the Guild, nor vote in any Guild elections or referendums. They shall be entitled to apply for associate membership of the Guild.
5. Associate members
Guild council may determine specific categories of persons who shall be eligible to apply for associate membership of the Guild.
Associate members shall be entitled to make use of any of the facilities of the Guild, which may from time to time be made available to them. They shall be entitled to attend General Meetings of the Guild in the capacity of observers without the right to vote. They shall be eligible for associate membership of any recognised society of the Guild, but, again, without the right to vote. They shall not be eligible to serve on Guild Council, nor to hold any office in the Guild. They are not eligible to vote in referendums or elections for Guild Councillors or for any officers of the Guild.
6. Honorary Life Members
In recognition of services rendered to the Guild, Guild Council may elect Honorary Life Members.
Honorary Life Members shall be entitled to make use of any of the facilities of the Guild which may from time to time be made available to them. They shall be entitled to attend General Meetings of the Guild in the capacity of observers without the right to vote. They shall be eligible for associate membership of any recognised society of the Guild, but, again, without the right to vote. They shall not be eligible to serve on Guild Council nor to hold any office in the Guild. They are not eligible to vote in referendums or elections for Guild Councillors or for any officers of the Guild.
7. Temporary Members
The Guild Council may on application grant temporary membership of a specified period to such persons or groups of persons as it may decide, provided that the period of membership shall not exceed twelve months.
Temporary members shall be entitled to make use of any of the facilities or amenities of the Guild, which may from time to time be made available to them. They may not attend any Guild meetings, nor become members of any Guild society, nor hold any office in the Guild, nor vote in any Guild elections or referendums.
8. Reciprocal Members
The Guild Council may make reciprocal arrangements with student organisations of other institutions of higher and further education. The students of institutions with which such arrangements have been made may be admitted to the facilities or amenities provided for the Guild on the production of a current membership card of their particular student organisation.
They may not attend any Guild meetings, nor become members of any Guild society, nor hold any office in the Guild, nor vote in any Guild elections or referendums.
9. Admission of Guests and visitors
i) Full and part-time members may introduce and entertain not more that two guests on any one day. The guest(s) shall provide personal identification and records of these details shall be kept. The member introducing the guest shall the name of the guest and enter his/her student ID card number in the visitors’ book, which shall be kept at the club.
On such occasions the members shall be responsible for the guests behaviour whilst on the club premises. Such guests shall be allowed to purchase and consume intoxicating liquor whilst on the club premises provided they have attained the age of 18 years.
ii) Members of visiting teams, including spectators, who are competing in events against club teams may, at the discretion of the Guild Committee and on the occasion of the event only, be admitted to the premises and shall be entitled to purchase intoxicating liquor for consumption on the premises.
10. Functions
i). In accordance with current licensing regulations members of the club may, at the discretion of the Guild Council obtain the use of the club premises for their own bona fide private function, provided such functions are organised by and the responsibility of a member of the club who shall be present at the function.
ii) The Guild Council may make the club premises available to non-members who wish to hire or use the club for bona fide functions which are booked in advance on such terms as it may direct provided that the number of such functions shall not exceed 12 in any one year.
iii) All persons attending functions authorised by the Guild Council in (i) and (ii) above shall be allowed to purchase and consume intoxicating liquor on the premises provided always that they have attained the age of 18 years.
GUILD COUNCIL
11. There shall be a Council of the Guild, which shall be composed as follows:
Ex Officio
(i) The Chairperson of the Guild Council.
(ii) The Executive Officers.
(iii) Student representatives elected onto the University Senate and Council provided they are full or part time members of the Guild.
(iv) Student representatives elected onto the University School Boards provided they are full or part time members of the Guild.
(v) The Chairpersons of the University Residence Associations provided they are full or part time members of the Guild.
(vi) Chairpersons of all Guild Committees
Elected members, elected by and from the full and part time members of the Guild
(vii) Representatives from each School, as defined in the Ordinance on the Schools of the University. Each School shall have five representatives, plus one representative for each 200, or part of 200, students within that School.
(viii) The Inter-School programme including Combined Honours shall have five representatives plus one representative for each 200, or part of 200 students.
(ix) Ten elected first-year undergraduate students, who are to be elected during the first term of the academic year.
(x) Ten elected undergraduate students who are returning sandwich students, who are to be elected during the first term of the academic year.
(xi) Five postgraduate students, who are to be elected during the first term of the academic year.
(xii) There shall be a General Franchise constituency, for which any student is eligible. There will be one General Franchise representative for each 400, or part of 400, full members of the Guild.
(xiii) There shall be a representative from each Guild recognised Sports Club and Society.
The quorum for meetings of Guild Council shall be one-third of its members.
12. Ex officio members may not serve in any elected category as a Guild Councillor. Any elected member who becomes an ex officio representative shall be deemed to have resigned from his/her elected post as Guild Councillor.
13. Ex officio members who happen to represent more than one category of membership shall have only one vote.
POWERS OF GUILD COUNCIL
14. Guild Council shall have the following powers:
(i) To deal with the appropriate University authorities on matters of proper concern to the students of the University, including academic aspects, discipline, and University government.
(ii) To recommend to Student Affairs Committee changes to the Ordinance on the Students’ Guild and to this Constitution, provided that these have been determined in the manner prescribed in the section REVISION OF THE CONSTITUTION below.
(iii) To recommend annual estimates of income and expenditure to University Finance committee.
(iv) To approve expenditure, including capital expenditure, within the level permitted by University Finance Committee of funds on student activities, running the Guild and on other authorised Guild purposes appropriate to its objects.
(v) To recommend to University Finance Committee expenditure above the level permitted to Guild Council.
(vi) To present the Authorised Accounts each year and a half-yearly financial statement to University Finance Committee.
(vii) To approve the investment of any Guild funds and report such investments to University Finance Committee.
(viii) To approve contracts or agreements entered into by the Guild
(ix) To authorise the creation of staff posts within the approved establishment
(x) To establish committees, groups, societies and clubs as may be deemed necessary to fulfil the objects of the Guild.
(xi) To establish such student officers as may be required. Any such officers shall be elected by and from the full and part-time members of the Guild and shall be registered as full-time students for the whole of their period of office. All elections for such officers shall be by a secret ballot in which all full and part-time members of the Guild are entitled to vote.
(xii) To receive reports from Executive Officers of the Guild and from its Committees on their actions, and such other reports as Guild Council may require.
(xiii) To remove any student officer from his/her position.
(xiv) To approve and amend the Regulations, Standing Orders and Procedures for the Guild, including those which govern Guild Council.
15 Elected members may serve for a period not exceeding one year, are elected every year and shall be eligible for re-election.
GENERAL MEETINGS OF THE GUILD
16. General Meetings may be called, as outlined in the Regulations .The quorum for any General Meeting shall be a total of 225 full and part-time members of the Guild.
17. The powers of the General Meetings shall be:
(i) To discuss and declare an opinion on any matter which affects the Guild.
(ii) To recommend to Guild Council changes to the Guild Constitution.
(iii) To seek clarification for any action taken by Guild Council or by members acting on behalf of the Guild
(iv) To remove any student officer from his/her position
REFERENDUMS
18. A referendum may be called to ascertain the opinion of the members of the Guild on an issue, which affects the Guild, in which case the question shall not be put to a General Meeting.
19. A referendum may not be called more than twice in any academic year to discuss the same issue.
20. A referendum may be called by:
(i) a resolution of Guild Council
(ii) a memorandum signed by at least 200 full and part-time members of the Guild, stating the issue on which the opinion of members is to be sought.
OFFICERS
21. President of the Guild
There shall be a President of the Guild. The President shall be elected by and from the full and part-time members of the Guild and must be registered as a full-time student for the whole of his/her year of office. All elections for the office of President shall be by secret ballot in which all full and part-time members of the Guild are entitled to vote.
22. Sabbatical years of office
Certain officers, as defined in the Constitutional Regulations of the Guild, may opt for a sabbatical year of office. No person shall hold a sabbatical office in the Guild for more than two years in total.
GENERAL MANAGER
23. There shall be a General Manager to the Guild, who shall have executive control of the administration and shall perform such duties as may be prescribed in Guild regulations. The General Manager shall be appointed with the advice of the University. He/she shall be responsible to the Guild for the execution of his/her duties.
REVISION OF THE CONSTITUTION
24. This Constitution shall be reviewed at intervals of not more than five years by Student Affairs Committee.
25. Changes to this Constitution may be recommended to Student Affairs Committee by the Guild Council; this may be done only after a General Meeting of the Guild has had the opportunity to discuss and debate the proposed changes.
26. Any recommendation for a change to this Constitution which is referred back to Guild Council may be re-submitted, whether modified or not, to Student Affairs Committee with the request that it be forwarded to the Council of the University for a decision.
AMENDMENTS TO THE ORDINANCE ON THE GUILD OF STUDENTS
27. Amendments to the Ordinance on the Guild of Students, which are proposed by Guild Council, shall be by a resolution of not less than 55% of the membership of Guild Council, at meetings held for such purpose. All amendments shall be submitted through Student Affairs Committee to the Senate and the Council of the University.
28 SUPPLY OF INTOXICATING LIQUOR
i) Intoxicating liquor may be supplied on the club premises to members, guests and visitors and to persons attending functions admitted in accordance with the constitution, provided they have attained the age of 18 years, during the permitted hours.
ii) Only members may purchase alcohol for consumption off the premises.
