Tier 1 of the Points Based Immigration System for Highly Skilled Migrants
The Points Based System is a new UK immigration system. The whole of Tier 1 is for highly skilled migrants and is the only Tier where applicants do not need a sponsor.
Tier 1 General
This scheme allows international students graduating from UK universities to apply to stay in the UK to find highly skilled employment. You do not need to have a job offer in order to apply. Applicants have to prove they have enough points to remain in the UK.
You need 95 points altogether. Students from Aston are most likely to qualify under the categories and sub categories outlined below.

This information page is aimed solely at those student graduates who are already in the UK:
75 points must come from the first section.
If you get more than 75 points you still need 20 points from the English Language and money categories explained below.
Age
20 points if under 28 years old
10 points if aged 28 or 29 years old
5 points if aged 30 or 31 years old
Qualifications
35 points for a master’s degree
50 points for a Phd
Previous earnings
15 – 45 points for previous gross earnings based on the best 12 of the last 15 months of your earnings in the 15 months immediately before making your Tier 1 General application.
UK Experience
5 points for having studied full time in the UK for one year or more and gained a qualification above the level of Bachelor's ; the qualification must not have been awarded more than 5 years ago.

20 points must come from the following categories
English language
10 points for proving competence in the English language
Money
10 points for having at least £800 in a bank account if you are in the UK
The balance must show that you have had at least £800 in your account at all times over the three-month period for applications submitted within the United Kingdom, and £2,800 for applications submitted outside the United Kingdom.
If you have dependants you will need an additional £533 for each.
If your funds are held in a bank account overseas, they convert the amount to pounds sterling using the rate which appears on www.oanda.com and the date on your bank statement, that have been in your account for at least three months before your application;

Other points to note
Sponsored students
If you are in the UK as a student who is sponsored by a government or international scholarship agency, or if your sponsorship by such an organisation came to an end 12 months ago or less, must provide the sponsor's written consent to the application
Cost from 6 April 2009
►It costs £820 to apply for Tier 1 General. The application form covers the work permit and the necessary visa.
►It costs £1,020 to apply in person at a Public Enquiry Office (part of the Home Office which is not in London)

Switching
►You can apply whilst you are in the UK with a student or work permit visa.
►You may apply if you are in the UK with any other Tier 1 leave to remain (e.g. with Post Study Work) or with a Tier 2 work visa or if you have an International Graduate Scheme visa
►You can not apply in the UK if you have a visitor’s visa.
►You must apply for Tier 1 General on or before the date your student visa (current leave to remain in the UK) expires.
Unusual but possible!
►You do not have to have completed your studies before you apply for Tier 1 G if you have a previous qualification which meets the requirements but if you need the 5 UK study points this won’t be possible.
This means that someone now in the UK as a student can, in rare circumstances, apply early for Tier 1 General by relying on another degree qualification that they gained earlier.
►You do not have to have completed your studies before you apply to for Tier 1 G if your previous earnings were high and you are still within the period of time in which you can rely on these earnings but if you also need the 5 UK study points this won't be possible. This means that someone now in the UK as a student can, in rare circumstances, apply early for Tier 1 General by relying on earnings earned just before commencing their degree.
If the application is successful you will be granted 3 years leave to remain with the option of applying for an additional 2 years to give you a final total of 5 years’ leave.
